Shelby Co. (ECWd) –

The Shelby County Board illegally hired a private attorney back in 2014 and continued paying for those services for years.  When the County Treasurer could not get an answer to the legality of paying for those legal bills she refused to pay them.  That action leads to two lawsuits.  One by the illegally hired attorney, Ed Flynn, and the other by a newly elected County Board member Mark Bennett.

During a hearing in December on the matter, the court granted Flynn’s summary judgment motion and appears to have ignored numerous facts.  Both the treasurer and board member Bennett appealed that ruling.  If the appeal is granted, which we believe should be based on the law, the court would remand it back to the circuit court for further hearings.

We encourage every single board member as well as citizens to read the briefs filed so that they can educate themselves on the law and how it is to be applied.
