Illinois (ECWd) –

With his trial supposed to start this morning, former Illinois Senator Sam McCann claimed he was not ready to proceed due to medical conditions, however, the Government indicated he was medically cleared for trial.

After several recesses for McCann (Pro Se (acting as own attorney)) to confer with appointed Stand-By counsel, McCann finally and voluntarily terminated his self-representation and accepted appointment of an attorney.

The bench trial is continued until tomorrow, February 13th at 9:00 a.m.

The Docket Entry:

Minute Entry for proceedings held before Judge Colleen R. Lawless. Status Conference held on 2/12/2024. AUSA Timothy Bass present on behalf of the Government. Pro Se Defendant, William Samuel McCann Jr. present, along with Stand By Counsel Jason Vincent. Discussion held regarding medical events that occurred. Government indicates the Defendant has been medically cleared to proceed to trial. Defendant states he is not ready to proceed to trial for medical reasons. Recess taken so Defendant may speak with Stand By Counsel. Discussion held regarding Defendant’s medical condition. Arguments heard regarding Defendant’s ability to proceed to trial. Recess taken so Defendant may speak with Stand By Counsel. Court accepts the Defendant’s voluntary choice to terminate his self-representation. Attorney Jason Vincent appointed as counsel for Defendant. Defense counsel requests a continuance to allow counsel to meet with Defendant. Government objects to continuance. For the reasons stated on the record, the Court continues the Bench Trial to 2/13/2024 at 9:00 AM. The Court finds pursuant to Title 18 U.S.C. 3161(h)(7)(A) that the interest of justice in granting the continuance outweighs the public and Defendant’s right to a speedy trial. Discussion held regarding specific witnesses appearing via Zoom. Defendant waives his right to confront the named witnesses in person. The Court finds the waiver voluntary and knowing. The witnesses stated on the record, are allowed to appear via Zoom. Court adjourned. (Court Reporter NF.) (JPL) (Entered: 02/12/2024)
